How does a 1031 Exchange work exactly?

While there are many types of exchanges, the Delayed Exchange is the most commonly used. A Delayed Exchange occurs when there is a time gap (a maximum of 180 days) between the sale of your old investment property (Relinquished Property) and the purchase of your new investment property (Replacement Property).

The 1031 Exchange process is very specific. We urge you to call us for a free consultation at 1.800.608.1031 so that we can walk you through your unique situation.

However, the following is a brief overview of the Delayed Exchange Process:

Step 1: You must sell your Relinquished Property. Once you close on this property, the proceeds must be delivered to a Qualified Intermediary.

Step 2: You must identify Replacement Property within 45 days following the sale of your Relinquished Property. You may generally identify three properties as a potential Replacement Property. There are alternate rules of identification for properties that do not fall under the 3 properties rule.

Step 3: You must purchase your Replacement Property within 180 days following the sale of your Relinquished Property. Your Replacement Property must be one or more of the properties that you identified during Step 2. At your Replacement Property closing, the proceeds are paid directly by your Qualified Intermediary. You then receive the Deed to the Replacement Property.
